Welcome to ERO Industries LLC ("ERO," "Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website, products, and services. By accessing our website or purchasing any products, you agree to be bound by these Terms.

1. Company Information

ERO Industries LLC designs, manufactures, and sells aftermarket parts, accessories, apparel, and related products for electric dirt bikes, electric motorcycles, electric bicycles, skateboards, and other action sports equipment.

 

2. Eligibility

By purchasing from this website, you represent that:

  • You are at least 18 years old or have permission from a legal guardian.

  • You have the legal authority to enter into this agreement.

  • You will use our products only in accordance with all applicable laws.

 

3. Product Use

Many ERO products are intended for off-road, competition, recreational, or closed-course use.

Our products may alter the handling, performance, or characteristics of a vehicle or equipment.

Improper installation or use may result in serious injury, death, or property damage.

It is the purchaser's sole responsibility to:

  • Properly install all products.

  • Inspect products before each use.

  • Maintain all equipment.

  • Verify compatibility with their vehicle.

  • Follow all manufacturer recommendations.

  • Operate equipment safely.

Professional installation is strongly recommended.

 

4. Assumption of Risk

Action sports, including but not limited to riding electric dirt bikes, motorcycles, bicycles, scooters, skateboards, and similar equipment, are inherently dangerous activities.

By purchasing or using any ERO product, you acknowledge and voluntarily assume all risks associated with:

  • Riding

  • Jumping

  • Wheelies

  • Racing

  • Stunting

  • Freestyle riding

  • High-speed operation

  • Off-road riding

  • Equipment failure

  • Mechanical malfunction

  • Improper installation

  • User error

  • Collisions

  • Falls

  • Environmental hazards

These risks include serious bodily injury, paralysis, permanent disability, death, and property damage.

You knowingly accept these risks.

 

5. Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERO INDUSTRIES LLC, ITS OWNERS, EMPLOYEES, AFFILIATES, MANUFACTURERS, DISTRIBUTORS, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Personal injury

  • Death

  • Property damage

  • Lost income

  • Lost profits

  • Vehicle damage

  • Product misuse

  • Installation errors

  • Mechanical failures

  • Consequential damages

  • Incidental damages

  • Punitive damages

  • Indirect damages

This limitation applies regardless of whether damages arise from negligence, product use, improper installation, modification, misuse, abuse, or normal wear.

Your sole remedy for any claim shall be limited as provided under these Terms.

 

6. Customer Responsibility

You agree that you are solely responsible for:

  • Proper installation.

  • Safe operation.

  • Inspecting all products before every ride.

  • Wearing appropriate protective gear.

  • Following all local, state, and federal laws.

  • Determining whether a product is suitable for your intended use.

ERO does not supervise or control how customers use our products after delivery.

 

7. No Warranty of Fitness

Except where prohibited by law, all products are sold:

"AS IS"

"AS AVAILABLE"

ERO disclaims all implied warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

We do not guarantee that any product will prevent injury or improve rider safety.

 

8. Limited Warranty

Unless otherwise stated on the product page, ERO products are warranted only against defects in workmanship or manufacturing for 30 days from the date of delivery.

This warranty does not cover:

  • Crashes

  • Racing

  • Stunting

  • Wheelies

  • Competition

  • Improper installation

  • Abuse

  • Misuse

  • Cosmetic damage

  • Normal wear

  • Corrosion

  • Modifications

  • Unauthorized repairs

  • Damage caused by other components

ERO reserves the right to repair, replace, or refund the purchase price at its sole discretion.

 

9. Compatibility

Customers are responsible for verifying compatibility before ordering.

Vehicle descriptions are provided for convenience only.

ERO is not responsible for incorrect orders or incompatibility resulting from aftermarket modifications or customer error.

 

10. Apparel

Sizing charts are provided as estimates.

Minor color variations may occur due to monitor settings, manufacturing processes, or printing methods.

 

11. Intellectual Property

All content on this website, including but not limited to:

  • Logos

  • Product names

  • Designs

  • CAD models

  • Product concepts

  • Graphics

  • Images

  • Videos

  • Product photography

  • Marketing materials

  • Website design

  • Text

are the exclusive property of ERO Industries LLC and may not be copied, reproduced, modified, reverse engineered, or distributed without written permission.

 

12. User Generated Content

If you submit reviews, photos, videos, or social media content featuring ERO products, you grant ERO Industries LLC a perpetual, worldwide, royalty-free license to use, reproduce, publish, edit, and display such content for advertising and promotional purposes.

 

13. Pricing

Prices may change without notice.

We reserve the right to correct pricing errors at any time, including after an order has been placed.

If a pricing error occurs, we may cancel the order and issue a full refund.

 

14. Orders

ERO reserves the right to:

  • Refuse any order.

  • Cancel any order.

  • Limit purchase quantities.

  • Verify payment information.

  • Cancel orders suspected of fraud.

 

15. Shipping

Shipping estimates are not guaranteed.

ERO is not responsible for delays caused by:

  • Shipping carriers

  • Customs

  • Weather

  • Natural disasters

  • Government actions

  • Labor disruptions

  • Incorrect customer addresses

  • Other circumstances beyond our control

Risk of loss transfers to the customer once the package has been delivered to the carrier, except where applicable law requires otherwise.

 

16. Returns

Returns are accepted only in accordance with our Return Policy.

Products must be unused, uninstalled, and in original condition unless otherwise required by law.

Custom products, made-to-order items, clearance items, and digital products are generally non-refundable.

 

17. Indemnification

You agree to defend, indemnify, and hold harmless ERO Industries LLC, its owners, employees, affiliates, contractors, suppliers, and agents from any claims, lawsuits, damages, liabilities, losses, expenses, or attorney's fees arising out of:

  • Your use of our products.

  • Improper installation.

  • Modification of products.

  • Violation of these Terms.

  • Violation of any law.

  • Injury to yourself or others.

  • Property damage.

 

18. Limitation of Liability

To the fullest extent permitted by law, ERO Industries LLC's total liability arising out of any claim shall not exceed the amount paid by the customer for the specific product giving rise to the claim.

 

19. Force Majeure

ERO shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, supply chain disruptions, pandemics, cyberattacks, utility failures, or governmental actions.

 

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

 

21. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

 

22. Entire Agreement

These Terms constitute the entire agreement between you and ERO Industries LLC regarding your use of the website and purchase of products.

 

23. Changes to These Terms

ERO may modify these Terms at any time without prior notice.

Updated Terms become effective immediately upon posting to this website.

Continued use of the website constitutes acceptance of the revised Terms.
